He was arrested Wednesday and is awaiting an evaluation by the Food and Drug Administration in San Diego, he said.
Giannini, who was arrested in May of this year, was charged with three counts of trafficking in drugs and possession of drugs, along with another person, according to the lawyer.
Giannini said the seller, who has not been named, was selling Viagra at his store in the Triangle, but he said he knew that he had purchased Viagra from an online seller, who he knew also had sexual contact with Giannini.
Giannini told the court that he purchased Viagra and other drugs from the seller, who he knew had sex with Giannini, but he said he knew the seller had no sexual relationship with Gannini.
Giannini, who had been arrested and charged in March this year for illegally importing drugs, said that the seller had no rights to sell Viagra at his store.
He said he had no knowledge that the seller had sex with him at his store, so he had no option but to sell the pills himself.
Giannini has been accused of selling drugs and money to his clients at the Triangle, but he said he has never been arrested for selling drugs.
